These terms of Website Use (together with the documents referred to therein) informs you of the terms of use on which you may use of our website TricelSiteAssessor.ie (our site), whether as a guest or a registered user. The ‘use’ of our site in this instance is defined as accessing, browsing, report generation through use of the planning tool on the website, or registration to the site.

Please read these terms of use carefully before you start to use our site, as these will apply to your use of it. We recommend that you print a copy of this for future reference.

We are registered in Ireland under company number 75014 and we have our registered office at Ballyspillane Industrial Estate, Killarney, Co. Kerry, Ireland. Our VAT number is IE4547159B. The site is designed as a tool to be used solely by professionals or those with indepth knowledge of undertaking site assessment for the purpose of selecting a suitable Wastewater Treatment Systems.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights on our site, and in the material published on it. All such rights are reserved.

You may print off and download reports (s) from our site for your personal reference and you may use these for the purposes of site assessment of wastewater systems, including the use of same for the submission of planning applications.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Use of information

The content on our site is designed to be used by professionals or those with indepth knowledge of undertaking site assessments for the purpose of selecting a suitable Wastewater Treatment Systems. It is designed for the purposes of recommending suitable solutions to meet the criteria set out by the user. Although we endeavour to ensure that all information on the website is accurate and up to date, we make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up-to-date.

Nothing on our site amounts to or should be treated as a contractual offer.

General Data Protection Regulation (GDPR)

Tricel takes our obligations under the General Data Protection Regulation (GDPR) very seriously. As a Registered User of the Tricel owned Site Assessor website tool, it is a condition of use that you, in your role as Site Assessor, have obtained the “signed written consent” of all your clients/potential clients to share elements of their personal data with Tricel and/or other Third Party Providers, BEFORE any of your clients/potential clients personal information is inputted by you, or retained on the Tricel owned Site Assessor website tool.
Tricel will not accept any responsibility whatsoever for personal data collected by a Site Assessor that is subsequently inputted by the Site Assessor on the Tricel owned Website tool, without the signed and written consent of the Site Assessor clients/potential clients.
In the event that Tricel are advised that a Site Assessor has inputted personal data from his/her clients/potential clients onto the Tricel owned Website tool without the signed and written consent of his/her clients/potential clients, Tricel will immediately suspend IT access for the Site Assessor. Tricel will also liaise with the Data Protection Commissioner on the matter, as part of our Statutory obligations to the Data Subjects effected.

Limitation of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Use of, or inability to use, our site; or
  • Use of or reliance on any content displayed or downloaded from our site.

All conditions, warranties and other terms, which might otherwise be implied by statute, common law or the law of equity.
